  • So desperate,Proof of domicile?????

    Hello,

    Lately rejected from us embassy in F1 immigrant visa. my mother is 62 year's old us citizen who is my petitioner and lives with my brother in houston. she does not have home or old bank account. i have submitted her medical records,my brother tax records including her name,copy of my mother 's us passport,still concular officer is not convinced.

    so desperate after 8 year's waiting .anyone can help me?

    Your case seems to be similar to me but in my case knowing to fact that the person ( petitioner ) who has filed for his/her son should have enough sponser.So,in your case,since your mother was not doing job,she cannot sponser you.If she might have less sponser than wut required,then she can ask your brother for joint sponser.This is wut I know...may be something wrong...So,better consult some lawyer...
    Now,can you please tell me following details about your case.I just want to predict when my priority date will become current. Your country of origin,date of petition ( both filed under F2B category and transferring from F2B to F1,if done) and when you received visa call after summitting DS-230 form. Thanks in advance...

      Goodluck to u fellw ,You did not get the exact problem in my case .when sopnser does not have job ,so he/she will use co-sponser in order to fil affidavit of support forms .

      but in my case sponser is under question because of proofs of us domicile.i am in iran and my petitionbegan at Feb/1999 and it took me 8 month after filling D-230 forms to be in interview.

      prepare yourself for this problem and ask your mother to open an bank account , rent a home , buy a car . i know it is riddiculous but after 8 years i am in the middle of hell ,so if you predict this ,you might pass this step.

        The consular officer is not convinced of what exactly?
        What exactly wa sthe basis of the denial?...they usually say under what section and what it is
        Your case seems to be simple: your mothers inability to do a I-864...she doenst ahve to , your brother or someone else could

            Thank you for reading my post and being concern about my case.My aunt is my co-sponser with complete "affidavit of support" documents but problem is in my mother status.

            My visa is in pending status through section 213A.consular officer was not convinced of my mother domiciliary(Residency) in US .My mother does not own/rent a home or did not have bank account during these years but My mother is 62 year's us citizen living with my older brother(He is a doctor) so he takes full responsibility and custody of our mother .my mother has serious hearing disabilities so she can not live by herself.(now she is in us)

            Lately i have provided copy of us/iranian passport ,new bank account statement ,my mother medical records in us(Not under any medicare) to embassy .still they are not convinced .

            I am so desperate and i can not believe this, after 8 year's.

              I guess my difficulty is that if she is a US citizen, why doe sshe have to prove that she resides in the US? a citizen , living outside the US can petition for a child. Why dont your aunt and brothe rretain an experienced immigration attorney to help?...........Im sure your nationality is playing a factor in all of this..

                yes,It is hard for me to believe my visa is in pending and i am sure it has something to do with my nationality. but petitioner should prove his/her residency in us even if she/he is a us citizen .check the bellow link

                  O.k youre right. How about a state ID card to rpove her address? I would get her some ID, open a bank account, Im not sure what the tax laws are but if she is claimed as a dependent on your brothers taxes, I would sne dthat too. I would sned all the evidence at once with a letter asking for a reconsideration. I would have an attorney write that letter though.
