  • Q with insufficent assets

    I have a question regarding the form i-130, I am married to a citizen who has insufficent assets and no employment at this point, so i need to time to apply for i-485, can i apply to i-130 first and then send i-485 to be in status, i do not want to be out of status for more than 6 months. If i do that will that delay the procedure.

    Yes, you can first file I-130 and then file I-485. No problem.

          Thanks, i have another question for later on. I read about this fraudalant marriage interview and it looks scary. Me and my husband got married after we have known each other for 3 months and after i have been in US for 4 months, but this is my third time in US. I came as a PHD student, he was a post-doctorate student in the same university. He is also 16 years older than me, he has a pHd, i have a masters degree, i am no longer attending the school and both me and him are poor but both of our families are well off(his sisters and brothers, my parents). I am the only child, he has 10 sisters and brothers. He is from Dominican Republic and I am from Turkey. I did not and do not plan to tell my parents about this marriage until i have the green card, i do not wanna be a widow in a muslim country. But i know his relatives and we already have a joint bank account and insurance and credit cards and we live together and we traveled to orlando together. So what are the chances of we getting this fraudelent interview, is it too risky for us to apply for green card. I do not want anything happening to him, i do not mind about being deported, but i do not want him to get presecuted. I love him very much and he is like an angel, I am sorry, this is a long e-mail.
