    HI,

    I am a US citizen and want to apply for GC for my parents who are currently in the US on visitor's visa due to expire on March 1st, 07. I have a few questions:

    1) Since their I-94 is valid only till march 1st, should I apply for a) I-485 alongwith the I-130? b) Or should I apply for a visitors visa extension? c)Or is neither is required?

    2)If I need to file I-485, are their birth certificates required? My parents' BCs are laminated, are they acceptable?

    3)For I-864 Affidavit of support - I am currently unemployed, can my husband who is a US citizen sponsor them? Does he need to fill out the
    I-864 A?

    If you submit I-130 and then try to do visa extension, it will be denied, so if you want your parents to stay in the states while they are adjusting submit I-485 as well. Yes, their birth certificate will be required. Your husband can NOT sponsor your parents, he can just co-sponsor with you

      Thanks for your prompt reply. Few clarifications -
      1)Their BCs are laminated, are they acceptable?

      3)Does my husband need to fill the I864-A?
