  • Applying GC from US (parents on visitor's visa)

    My parents arrived here on visitor's visa. I am thinking of applying for GC for them. I live in SF Bay area. Can anyone advise me whether it makes sense to apply for 130 and 485 simultaneously. What is the approximate timeline for getting the green card.

    if you are a US citizen, then only, you can file 130+485. and yes, it's advisable....I am also in SF bayarea, have read about 2-3 people's experience for parents. GC came in within 2 months, without interview. good luck !

      One more question - both my parents don't have birth certificate. Does birth certificate need to be submitted with I-485? It might be difficult to get an affidavit also from India as they are here now.

        1 of the 3 things needs to be sent with the 485

        1. BC copies of applicants

        2. Non availability cert (from authority in india). There's a sample here on this site somewhere...

        3. 2 Sworn affidavits from elder members of their family stating that they are related to this person (bro /sis), and confirm the date of birth. Sample is here again..on immihelp

        Without one of the 3 sent with the 485, odds of u getting RFE'd are 100% .
