  • I filed taxes late... how will this affect AOS app?

    We are just getting ready to start the AOS process... The attorney needs copies of my taxes for the past 3 years... the problem is I can't find copy of 2004 (can I get this at my local office or do I have to request it via mail? I know it takes two weeks to get it in the mail through the IRS!); also 2005 and 2006 were never filed! Don't know how I forgot to get this done! I told the asst at the attorneys office and she said that we will just deal with it if it becomes an issue. I wasn't really happy with this answer. I am really concerned about this. Does anyone know how this may affect, if at all, the AOS process for my husband?

    You forgot to file taxes for 2005 and 2006? and you do not know how it happened?... tsk, tsk.

    You can request your IRS transcrits for 2004 faxed to you, call the IRS costumer service line.

    This will affect your AOS, if your are sponsoring your relative, because they look at your tax history to see that you can act as a sponsor.

    File your taxes. Bring evidence of such.

      Thanks for your quick responce... once I file it I just need to bring copies of what I file correct? I know that they have to verify my income based on these past tax documents... I guess my biggest concern is whether, once I submit the taxes and have the copies, will the fact that I filed late be held against us or cause a problem with the AOS process?

        I do not think so. For as long as you have indeed filed them, everything will be fine.

        Also, bring your employment letter and pay stubs for the past 3 months.
