I-130 upgrade
Hi
I have two questions,
I had filed I-130 for my spouse in Mar 06,it is still pending.I would be applying for citizenship in March 08 and eventually upgrade my petition or apply for K3 if i could.The processing dates are stuck on jan 06 for past 4 months.Incase the petition is not approved by the time I am a USC,would it be smart to apply for K3 because I would have a pending I-130 without calling in to upgrade the I-130.i have heard that consular processing for 1-130 is much longer that for K3.Incase it is approved,how long does the upgrade process takes on average.
Second,My father,a GC holder had applied for my elder sister in Aug 03 while she was unmarried.The petition got approved in sep 05 but the wait time was awful so she got married in Dec 06.We had sent copies of her marriage certificate and my brother in law's birth ceritificate to notify USCIS of that change and they sent us a letter back saying that your case is under administrative processing and we will let you know when we make a decision.My question is once my dad is a USC can he upgrade this petition because she was unmmaried when the petition was filed,even approved.????
