    Hi,

    I am currently in US with F1-VISA and brother is citizen.
    Since I am in Fourth Preference Group, it's going to take more than 10years to have immigrant visa number even if USCIA approves my immigration petition.

    My question is
    Can I apply for work permit if the US approve my immigrantion petiton?
    (Before having the immigrant visa number, in other word if I'm in the waiting list)

    For me it is unrealistic to wait more than 10years if I can't work in America.
    Please let me share your experience and/or knowledge about this issue.

    No, you can not get a work permit based only on an approved I-130 (immigrant petition).

    People have done F1 visa for 4 years, then OPT for 1 year, then convert to H1 visa for 6 years... and then a visa number is available for them. O

    Other than that, you have no other legal way to work in the USA.
