Marriage after asylum denied

I have a valid visa which will remain legal till the beginning of 2009. i have asked for an asylum and given first notice of intent to deny and then after 5 months deny. Now i met a genuine usa citizen and planned to marry for good . still i do have valid visa for the remaining 5 months. so with respect to legal perspective [USCIS], am i legal to pursue my marriage [ not to be considered fraud]?

your visa expiration has nothing to do with how long you are allowed to stay in the USA.

You were issued an I-94 form with a date on it. When did this expire?

USCIS will suspect of marriage fraud, since you were probably ordered to leave the country right? and now you found an USC to marry... so be prepared.

i had not been ordered to leave the country. as i told you i have asked asylum when i was in of status which the lawyer did not told me before i have been denied. the date printed on the I-94 is on february 2009. i have been asked by USCIS only to fill a form for change of address...nothing more [ there is no order for leaving the country]....i think now everything is clear for you
