Thanks for putting the time and effort to have this great forum.
I have read a bit and tried to search but couldn't really find what I was looking for.
Facts:
- I am a US Citizen by birth in the states.
- I have been living outside of the US most of my life.
- I do visit a lot for periods ranging from a couple of weeks to a
a few months.
Situation:
I have filled an I-130 petition for my spouse recently.
(been married for over than a year and a half now) and we got
initial approval by receiving a package that has all the required
information to proceed and a date/time of an appointment to be held.
Amongest the forms is the affidavit of support form.
Now since I do not live nor work in the US I can't show any US tax returns.
I read that in order to prove you can take care of your spouse in the US, you need to prove that you have 125% above poverty level which translates to
some $50,000 in the bank.
I am not sure what to do at the moment, I would like to have all my papers and forms ready, but one thing that I do not know how to prepare for is
the affidavit of support form.
is there any known rule of thumb that states how to show that the petitioner can support the beneficiary if both of them are not living in the US?
A simple question might come to your minds regarding me; is why are you filing for this if you are not living there now?
simply put, I will be living/working in the US but due to the nature of my work in consulting, it is hard to predict when exactly that'll happen so I just need to get all papers and the process ready and started to gain time.
I am planning for sometime in the coming 12-20 months.
