Hi Josh. LIFE Act cannot be used in your case because this is only for aliens who had resided continuously and illegally in the United States, without interruption since before January 1, 1982. Also you should have filed for it not later than May 31, 2003.

Your father or mother should file for you an I-130 petition, then you can apply section 245i in order to avoid deportation since you will be grandfathered by the old petition filed for your parents when you were young.

Better yet consult a good immigration lawyer.

Hi again Josh. My first post applies to certain LATE LEGALIZATION CLASS MEMBERS, e.g. LULAC.

In general, LIFE Act has different provisions depending on the status of the petitioner (immigrant or citizen). For immigrant petitioner LIFE Act only applies to their minor children who have been waiting in line for at least 3 years. This is called “V” Visa.

In any case a new petition must be filed for you.

because i have already overstayed my visitor visa.

Hi Josh,

First thing to do is have your parent petition you. You cannot leave US while you're not in legal status bec u will be subject to the 3/10 year bar. A faster way to legalize is to have an employer petition you. Processing time is faster than family-based petitions. Are you a college graduate ?

Filing for H1B visa starts every 1st day of April each year and ends until all available visas are exhausted.

I suggest that you consult a good immigration lawyer so you will know your options.
