  • AOS interview completed but no card or update

    My I-130 was received by USCIS on 9/30/2009. Biometrics completed on 10/29/2009 (Accepted for walk-in; originally scheduled to 11/06/2009).

    My wife (who is sponsoring me) and I went on the AOS interview in Jacksonville on 12/17/2009. We both had a good impression about the outcome, but did not really get any official "your case was approved" statement. However, the interview was very short and the officer was very friendy and told us not to forget to apply for the permanent Green Card in two years, so I assumed that we passed the interview. She did not stamp my passport or tell me that my application was approved.

    I am a little worried since the card production had not been ordered yet. Also when I log in to case status on USCIS it was not updated since October. not only it doesn't show that I had an interview, it does not even show that I was scheduled for one!

    Currently, the case status reads:
    " Request for Evidence
    On October 26, 2009, we received your response to our request for evidence. This case is being processed at our NATIONAL BENEFITS CENTER location.... "

    I have my EAD and advanced parole approved and am planing to go home for vacation.
    Should I be worried? from following the online trackers, my understanding is that it should not take so long after the interview to hear a response.

    You should not be worried at all. Things take time, the Immigration officers are slammed with work and sometimes it takes a little longer. They do not like to give applicants definite answers like "You are approved!" or "You'll get yoyr green card in 2 weeks!", etc. although they sometimes do. They also do not stamp your passport any more. You can go and get one once you receive your approval notice or your green card. The stamp is the proof of your status in case you lose the green card but do not worry about that, noone will erase your record in the system - even if you lose the card without a stamp you will always keep your status as a permanent resident at least for the next 2 years.

        Same story

        I am the petitioner, applying GC for my wife, The interview was on Jan 5th, 2010 in LA, CA. IO starting from my income & financial questions, which turns out that she did not have our RFE joint-sponsor I-864 file on hand, then I gave her my own copy.

        The rest of the questions went well, she didnt ask my wife too many questions, after 20 minutes interview she gave us a letter before we left, saying
        "An adjudicative review of your case is needed. No additional information is required from you at this time", its in 30days period.

        Dont know whats wrong with the interview?? Anyone has the same letter?

        But on the same day, Jan 5th, when i check on USCIS's web and found out EAD was approved. "On January 5, 2010, we ordered production of your new card. Please allow 30 days for your card to be mailed to you...", then pop out another update on Jan 8th, same message from USCIS.

        don't know if its normal to get EAD approved right after initial interview?

          HEY we are in the same boat,..i went for my AOS interview yesterday and everything went well...she didint ask a lot of questions was nice to us and at the end of the interview she said she'z going to approve and i should receive my conditional greencard in 6weeks....she also gave me a paper that says i should renew my greencard 3 months before two years expire......my lawyer told me the interview went well and congratulations on approval...but when i got home there was no update on the check status website...the last update was on october when they sent an RFE!!....I hope and pray that i get something in the mail soon like an approval letter or a status update on the site....i have heard horrific stories of people waiting years after they initially thought they were approved...the immigration officers are not very trust worthy people

            I-485 case in National Benefits center

            Hello.

            My I-485 case was just transfered to the National Benefits Center with no particular reasoning by the USCIS. I had initially filed under the EB1b category.

            Does this transfer mean that I WILL be called for an interview or not necessarily (is this a normal step of the process). I have recd the EAD and advanced parole already. Thanks for any information!
