    Good Day!
    Appreciate advice or direction.
    My wife and I competed the adoption of her nephew when he was 11 years old, the adoption decree/legal custody was granted Oct 2013, I become a US LPR on Sept 2012, my wife becomes an LPR in Oct 2014.
    My wife has joint physical residence with our adopted child from when he was 6 months old until she departed to the US on in Oct 2014 and became LPR. We can show proof of parental control and residence.

    MY question is what is required or what do I need to comply with so that I can successfully petition my adopted child using form I-130, me being a USC

    You need to show the adoption decree and evidence that your wife resided with the child for at least 2 years.

      For physical custody, we have fulfilled more than two years and we have complete evidence.

      How about 'legal custody', do we need to be completely living with our child for atleast two years after the decree was released/issued?

        You need to have had legal custody of the child for 2 years, but those 2 years don't have to be the same 2 years as the 2 years of residence.
