  • Accompanying parents

My brother (US citizen) filed I130 for my parents (Immediate relative visa I think). My parents will be attending the interview soon and I wanted to know if I can accompany them and get a visa too.
    Im currently 18 years old.
Please if anyone has information about this case tell me

It depends on if you were I-130. I know for other visa types a derivative can "join" even if they weren't initially on the first petition. But those people would get a big slap on the wrist from the US consulate. You should find out if you are considered a derivative and can join the petition even if you weren't initially on the original. My gut feeling is that you cannot simply join in like other derivatives. You will most likely have to be filed for another petition I-130. please check
    --Good luck--
Good luck. I learned the hard way, I hope you don't have to. Immigration is interesting. Not considered as legal advice.

The OP can't be a derivative beneficiary -- the Immediate Relative category (spouse, parent, or unmarried under-21 child of US citizen) cannot have derivative beneficiaries.

This is my personal opinion and is not to be construed as legal advice.

Do I benefit from it being current if my parents file I130 for me soon? Do I need my case to be approved first or doesnt matter?
