  • Need some help and Guidance I-130 . Over age during Visa Availability time

    Hi I need some help and guidance. I applied for my brother I-130 on family basis . Priority date was 22-JUL-2005. Case was processed and sent to National Visa center in April 2010.
    Visa became available in 2020 while interview date was schedule . There was a wait time of approx 10 years. Three of my Brothers kids are now 27, 26 and 24. If those 10 years are deducted they become 17, 16 and 14.
    Consulate denied visa on the basis of their ages. We tried to explain Child Status Protection Act (CSPA) but they did not listen. What options we have now ? Should we hire an attorney , if yes where in US or in that country ? I will really appreciate any help . Thanks in advance.

    I think your wait time was 5 years (April 2010 - Jul 2005)
    so your children's CSPA Calculated ages are 22, 21, 19
    I think one or two of them are applicable for visa
    Did you paid fees for all of them ?

        Then, In that case sir,
        A child, for whom you paid the fees should have got the visas, As she/he is applicable for CSPA and you paid fees
        did he/she got visa ?

          No , they denied visa without giving any written reason.
