  • Question related pending i-485 with uscis

    Good morning

    I have few questions.
    1. can I file I 765 and I 131 without my lawyer help as my lawyer has previously transfer my I 485 but rightnow I can not afford him to file work permit .
    2. I called uscis and they told me that there is no fee for filing I 765 and I 131 as it is based on pending I 485. Or do I need to attach for I 912 for fee waiver.
    3. Through form AR-11, I have changed my address. But can I use different mailing address for my these 2 applications, I 765 and I 131 ?

    1. Yes, you can.
    2. Yes, that's correct. You will need to provide details of the pending I-485, NOAs you have received etc. for them to match it up with the pending AOS.
    3. I am assuming you are physically in United States.
      • For I-131, the form expects you to provide your U.S. physical address (in Part 1.) for the mailing. Part 3 provides some options to have it sent to a U.S. Embassy or Consulate or to a DHS office overseas, but I'm guessing you don't need that.
      • For I-765, you can indicate a mailing address in Part 2. U.S. Mailing Address (5.a.), which can be different from U.S. Physical Address (7.a)
USC filed AOS for parents on B2. I am not a lawyer.

Oh, and don’t file I-912 Request for Fee Waiver, because:
      1. You don’t need a fee waiver since there is no fee for these forms as mentioned above; and
      2. There is a question on I-944 Declaration of Self Sufficiency related to ever having applied for a Fee Waiver and you want to avoid having anything that counts against you in regards to being a public charge. This might be irrelevant for you since your AOS is already pending but people applying after Feb 24, 2020 (most of them anyway) need to file I-944.
