  • How to correct "Class of Admission" in I-130?

    My wife who is a Lawful Permanent Resident filed for my I-130 a few months back. However, today, when going through the application again, I noticed the "Class of Admission" (Item 46a) is set to EB3, when it should have been H-1B.

    My current status is H1B (noted in my I-94). I think we sort of confused it with my approved I-140 which is under EB3 category (and the online application tricks you by showing you a picture of green card and telling you to pick category from there). How can I have a green card, if I am applying for I-130!

    Coming back to the point, is this something important enough to correct/amend? If yes, how should I go about it?

    Thanks in advance for your help!

    PS: My I-140 is approved, but I am waiting for visa number for years because I am India-born. Hoping that I-130 based GC materializes before the work based one.

    If you did the I-130 online, there is a menu option to send an inquiry about a case. I would use that to explain the error or even try to contact USCIS by phone.

      Thanks! I followed your advice and contacted USCIS using the menu option at My Account -> Inbox and sending a message. Got this reply:

      Regarding your Form I-130, Petition for Alien Relative.
      The information you entered on your Form I-130, Petition for Alien Relative, will be verified by an adjudications officer before a decision is made. Therefore, if you made an error on your petition, the mistake will be verified and corrected by USCIS. If your information cannot be verified, you will receive a Request for Evidence (RFE) letter asking for clarification.
      Sounds like there is not much to do here from my side. But I still feel anxious. I am thinking to also contact on phone or through the live chat, to see if I can get it corrected any other way.
