  • Green Card for Parents - US citizen Living in India

    Good Morning

I am a US citizen by birth and I am 21 years old . I am living and studying in India from my childhood along with my parents. I would like to come to the US for my MS in the middle of next year.

Can I apply for a green card for my parents now (while living in India)? I know there is a ban on Immigration till end of this year. Can I submit I-130 application now(during the ban)? Or ban is applicable for submission of I-130 application also?

Can I post-pone and attend the interview when I reach USA? By doing this I can save some time and start green card process for my parents. Please let me know if I miss anything here.

    Thanks,
    Venkat

Yes you can file an I-130 now. But for filing the I-864 later, you will need to be domiciled in the US, or plan to reestablish domicile in the US no later than when they immigrate.

This is my personal opinion and is not to be construed as legal advice.
