Travelling to USA with approved Tourist (B1/B2) visa and approved I-130

  • Travelling to USA with approved Tourist (B1/B2) visa and approved I-130

    My parents have been to US multiple times on tourist vis and has no visa violations at all. Any advise whether it is OK to travel to US with approved Form I-130 and not having applied for AOS in India?

    Yes, but be advised that entry into the US is at the discretion of the officer and is not guaranteed simply because your parents have a valid visa.
    Canadian on F-1 married to USC (SSM)
    Field office: Manhattan/NYC

    09/21/2019: Delivered to Chicago
    09/25/2019: Fees charged
    09/30/2019: Case received
    10/04/2019: Biometrics appt received
    10/15/2019: Fingerprints taken
    10/16/2019: Fingerprint review complete
    11/14/2019: Ready to be scheduled

      Thanks manhattanite for your response. I definitely understand what you said. I was also wondering if anyone has gone through this experience. My concern is if the officer will ask questions on what they are coming to US without filing AOS in India and if they intent to file in the US.

        Why are you concerned? The answer to those questions should be easy and straightforward.

        The fact that you’re worried leads me to believe that something suspicious might happen. I strongly recommend that your parents be honest with these questions when asked. Being denied entry sounds bad, but trust me immigration fraud is a lot worse.

              Hi mk1234, Appears that Parents 130 has left his original thread since November 2020.

              I am also looking for someone to share experiences of their current I130 Status against the application filed by US citizens for Parents.

              My timeline is :

              Texas Service Center
              I-130: Receipt date 15 Dec 2020
              Case Status: " We are actively reviewing your case..... There is nothing outstanding ".
              Nothing else.
              16 months completing next week
              USCIS current Case Processing time is 11.5 months

                  also did you apply for 485/AP/EAD at same time? I have my moms I-130 filed Dec 28, 21 and it ended up in TSC (I live in CA).... I filed 485/ead/ap in April 28, 2022 and mom did her biometrics on June 3, 22.. no update after that..

                    No biometrics done yet. The I130 petition is for Consular Processing. Biometrics will be done only after approval, once he get interview appointment for Mumbai.

                          Not yet MK1234. I sent an online inquiry against "outside normal processing time"
                          Received a reply that the case is in the queue for adjudication.
