  • Filing questions form I-751

Short summary, in 2014 I moved to the US from Austria with an E2 visa, 2017 I got married and 2019 I have filed for a I-130/485, the limited permanent resident card will expire end of May and this is the first time I'm preparing the docs, in the past the company I worked for hired a lawyer. So I need to prepare my I-751 form and I have a couple of questions.

I have the instructions and form. It says charge is $595, but then on the uscis website it says that it was adapted, but they still accept the old amount, has anyone filed after September and the got approved with the old charge?

What is really confusing me are all the different names, at first I'm the conditional resident and my husband the US resident, later spouse and petitioner, but then I become the spouse? As Part 7 says petitioner= my husband, but Part 8 says spouse (=me?) or individual listed in part 4, but that would be the US citizen = my husband? It's confusing.

Also strange that for the physical address for the US resident they have included postal code, province, do I leave it blank?

Now when it comes to initial evidence required, it says exception, but not sure what it means, do I need to send the passport photos, as it says those who reside overseas pursuant to military.. which does not apply to me. Or those are the ones exempt from sending the photos. Again confused.

Evidence of the relationship, do I need documents for each item? I-130 instructions had a lot of examples, this one, not so much, but it says evidence from the duration of the marriage, so should I include the documents that were presented with the I-130 as well? Like marriage license and pictures? Other than that I would send joint tax returns, life insurance beneficiary, emergency contact, car insurance additional driver, we don't have any joint bills, it's either in his or my name, but the same address, so I would send some of those as well. Maybe also flight tickets and hotel reservations.

    Thanks

The fee change was stopped by the courts. The fee is still $680 ($595 + $85).

On this form, the "petitioner" is you, the conditional permanent resident. You are "petitioning" for your own conditions to be removed. You complete Part 7. Your US citizen spouse is the "spouse". He completes Part 8.

If the address is in a country without province, leave the Province field blank or put N/A.

You do not need to send passport photos. They will take photos at biometrics. People overseas with the military can use their own photos a fingerprint card as substitute for biometrics.

How much evidence you need is subjective.

This is my personal opinion and is not to be construed as legal advice.
