    My Mexican wife came here on a tourist visa. We've been married almost 4 years.

    I do not have employment as I am my elderly mother's caretaker. My mother earns roughly $31,000 a year in pension and social security.

    Can anyone please tell me which forms I must submit? Thanks in advance!

      The main forms are the I-130 petition and I-485 for Adjustment of Status. It is recommended that you also file I-765 for EAD and I-131 for Advance Parole, since they are free.

      Each form will require many documents and supplementary forms. Read each form's instructions for more details. For example, the I-130 will need I-130A (since it's for spouse), proof of your citizenship or permanent residency, two passport photos of each of you, marriage certificate, and evidence of bona fide marriage. The I-485 will require her birth certificate, her I-94, two passport photos of her, a photo ID of her like passport or driver's license, I-693 medical, and I-864 Affidavit of Support.

      One I-864 will be required of you as you are the petitioner. If your current household income (i.e. your current salary of your current job, plus the current salary of the current job of any of your dependents) does not reach 125% of poverty level for your household size, then your mother can act as a joint sponsor, in which case your mother will fill out a second I-864, and your mother's current household income needs to reach 125% of poverty level for her household size. Your mother's household size will include, your mother, your mother's spouse if she is married, your wife, and any dependents that your mother claims on her tax returns. What income is needed for 125% of poverty level can be found at I-864P.
