  • lacking co-sponser,can benef. abroad shows promise of employ.in U.S for his interview

Bonjour, Salam, Hi everyone in this forum

I'm a desperate GC holder who can't find a co-sponsor to bring my husband to U.S. my 2009 income was $20000 but the income for 2008, and 2007 was $10000 and $3000 respectively while I was a full-time student in the U.S.this year I returned to my husband country of citizenship supposing that it takes more than 5 years for me to bring him to U.S.(i fulfilled the apppropriate forms in summer of 2009) so when we received the documents from NVC we got surprised. anyway, i have asked everyone i was acquainted with, to co-sponsor my husband. but since the economical situation doesn't seem very stable, friends and my sole relative are afraid of doing that.(I completely understand them).regarding that i have some thoughts that i don't know if they seem logic or not, and maybe you can help me to discard them if they are not applicable. I appreciate in advance.

1- Can I deposit like $10000 or a little higher in our mutual account in the U.S. to cover the 125% income shortage in my 2007 & 2008 income? [Can having money in a U.S. account be conidered (by U.S.immigration office) for sponsorship purposes? (I-130)

2-If he can find a job in U.S.;a job that doesn't provide him with GC but with a promise of employment if he has got his GC; can I(the sponsor) use it to cover my lack of 125% income in 2008,2007 regarding thant the beneficiary is not living in the U.S.?
it's five months that i'm living with him so for 2010 year i'm considered UNEMPLOYED in I-130 form.

Thanks if you have any idea, or you think i'm mistaken

Yes you can deposit the said about but as per I-864 instructions for Q29 TOTAL VALUE OF ASSETS - "In order to qualify based on the value of your assets, the totalvalue of your assets must equal at least five times thedifference between your total household income and thecurrent poverty guidelines for your household size." Read that in detail please.

No promise of employment is not considered to make up the 125%.

As long as your current annual income meets the poverty guidelines you have nothing to worry about. Don't worry about your past years income as long as your current annual income meets the poverty guidelines.

    Good luck.

      Thanks a lot,
I just want to mention that at this time i'm UNEMPLOYED. so in I-684 i ought to tick UNEMPLOYED.so basically, i have just my 2009 income which is above 125% poverty line.

        Yes you tick unemployed.

As you are currently out of work they will probably give you a year to submit evidence that you are financially stable. In this time you can find a job or maybe a joint sponsor.

        Hope everything works out.

        Good luck.

          I-864, foreign income as intern,

          Thanks visjig,

i didn't know that in I-864 form, there is a field for sponsor to fulfill her current (not 2009) income and her current employer's name. Alas, i was thinking that the form asks for 2009 tax and won't ask about my current status.

I have 2 questions and I hope to hear your idea about them.

as i mentioned, I Iive with my husband for the last 5-months and i'was doing an internship in a Company (not U.S.based but with branches in U.S.). My income from this internship is less than $7000 for the last 5-months, and it's going to finish this very soon.
          my fist question is :

1-If i tick that i-m employed in Q22 of I-864, my foreign income for 2010 along with my husband assets abroad, can be more than 125% of poverty line. But this declaration shows clearly that I have been abroad for at least 5 months and since i'm a GC holder, this declaration makes me anxious.
(and may be i repeat staying with him in near future if i can't bring him to the U.S.)
          --------------------------------------------------------------------------------------------------------
I haven't changed my address in IR-11 when i came to my husband country 5 I kept a U.S.mailing address for the last 5 months)andi f i declare that I'm doing an internship in the I-864form, they can question me for not abiding the law of notifying USCIS of change of address.
2-If i tick i'm employed in I-864, in part 4 of I-864 "information on sponsor" , i'm obliged to choose that "I'm living abroad temporarily" and bringing my reasons that I missed him & i look for an internship in his country to live with him for a while.

**** Do you suggest le to choose "employed" & "live abroad temporarily" & write down $7000
(In another way,Does NVC look for petitioner sponsors that have a job (income) currently in U.S. and
not the income that are temporarily and abroad?)
**** *or choose "unemployed" & mentioning that my country of domicile is U.S. (and not talk about live abroad temporarily)

sorry for long descriptions,I hope the questions and answers help others as well.
