  • Adjustment of Status through spouse.

Hello all, this is my very first post so i would like to introduce myself and ask a few questions. Any responses will be greatly appreciated.

I'm a 22 year old male born in Colombia, I arrived in the United States in 1999 with my parents on a visitor visa. My I-94 expired six months later and have lived in the United States Illegally since then. I attended middle school, high school and some college in the U.S. The United States is the only home i know being that i came here at such an early age. When i was 18 I met the person that would become my wife. We dated for a number of years and under my circumstances we decided that for the sake of our future and stability we should get married and adjust my status before time could make it impossible for me to continue my education and pursue my career goals.

We married on July 15th 2010 after a 3 year relationship. Great ceremony and reception, family and friends. Even though it was a small wedding we had an amazing time and it was beautiful.

Prior to our wedding we consulted an immigration attorney to answer some of the basic questions and we decided that we were competent enough to read and understand most of the instructions for the required forms. With the help of immihelp i was able to successfully complete all the required forms and put together the package.

I am aware that this process requires a lot of patience but i cannot help but worry and wonder if my process is headed in the right direction.

On September 2 i mailed the package containing I-130 + FEE, I -485 + FEE including two G325A, I-765, I-864 I believe i included enough evidence but not overwhelming to support the validity of our union. Included all documents necessary.

On September 4 the package was delivered by USPS
On September 14 i received an e-mail and text message "application/petition acceptance confirmation"
On September 14 both checks were cashed

    My questions are the following,

My case was routed to the "national benefits center" is this normal?

Will there be any big complications because of me living in the United States out of status? My understanding is that in 99% of cases they will pardon you because you are marrying a U.S citizen.

How long until i hear from them again?

I only have one doubt about the documentation provided, the passport photos i submitted were taken at CVS seemed to be poorly cut but the lady assured me that they were perfect for immigration and passports she also wore a tag that said "photography expert" should i be worried ? should i expect a RFE letter for passport photos?

Any input about my case or comforting words would be amazing right now. A new marriage, work, school and the uncertainty of a pending immigration case is not a very easy thing to deal with.

I wish you all the best of luck on your journey and i hope to hear your responses.

Thanks a million and i am sorry for the endless post.

There are no complications as long as you can prove that you entered US legally.
    Good Luck!

Daru, thanks for the response. Fortunately my mother did a great job with saving all documents from day one. I included copies of my i-94 with inspection stamp, copy of non-immigrant visa, and copies of the pages in which my passport had been stamped on previous trips to the United States. I hope that the evidence provided is enough to prove I entered legally.

I'm going tru the exact same thing right now
came here on a visa when i was 12 stayed in the u.s ever since now illegal
met my spouse been together for 4 years recently got married.

I started filling out my application for USCIS
but im starting to get really nervous..
Attorney said there is a chance that i could be asked to leave the country since I've overstayed my visa for this long.

but then i read online that the only way you are forgiven for overstaying is if you marry a u.s citizen

Please keep me updated or message me on your journey and steps

            @Lisa011

Relax, as long as you came into the country legally you have nothing to worry about -even if you overstayed. Once you are now married to a U.S citizen it will be pardoned. Donot let lawyer scare you. He probably just wants to make you think it is so difficult as I am sure his services don't come cheap. In many instances you don't even need a lawyer, but alot of persons are unsure of themselves and feel it is best to use a lawyer.

I am very close to two persons who went through what you are going through now. One lived in the U.S since he was 10 and one was smuggled in on a boat at 17. They are both good men who have made something of themselves ( one is currently serving in the national guard ) but were just placed in sad situations. They have both married U.S citizens sent the necessary paperwork and received their green cards both within the last 5 years.

Be honest, send in the requested info and keep the faith. Don't get scared and don't get stressed out.
