  • Indian Parents Green card - Birth Certificate

    I realize this question may have been asked here many times but asking again. I am applying for my Indian parents green card currently here in US. They dont have their birth certificates.

    They both are born before 1970 and thus per the reciprocity schedule between India and US, their birth certificates are deemed nonexistent. We have got 2 affidavits with close relatives (older than them) for each of them as their parents are deceased. We also have their school certificate which has their date of birth on it (but not place of birth.) I am attaching a cover letter explaining this in the application and also attaching the reciprocity schedule.

    Is there anything I can do to avoid RFE or any potential issues? Please let me know. Thank you.

      At what stage are you uploading these documents, OP? I already applied I-130 for my mom and she was born 1948. I did not upload any of these documents as I wanted to get the application in asap. I would get these documents only if I get a RFE later on.

        I am doing concurrent filing so submitting I-130, I-485 etc., all at same time.

        Is beneficiary birth certificate not required with I-130?

          You can always add it later on..I filed I130 , 3 days back and already got receipt notice... My mom was born in 1948 so she doesn't have a BC...will see if I can get a non-availability certificate in meantime. Its not a mandatory doc when u file as u can see in my case
