  • Filling form I-130 for Mother in Law (wife will applying)

    MIL is a widow. My wife will submit the I-130 for her. We came across some issues while filling it and would be grateful for any clarifications you can provide.
    1. Should beneficiary’s spouse field be blank or N/A since there is no current husband or previous husbands that were divorced? Or give date of husband’s death as date marriage ended??
    2. For the question asking for info about Beneficiary’s family – spouses – is it ok to give the details about husband and then mention under relationship that he is deceased? Or should this field be blank?
    3. What to do about question that asks if Beneficiary’s native language doesn’t use Roman letters? Does this apply only to people who provide information in the form in a language other than English? Our native language does not use Roman script, but English is a well established second language, and all official documents (birth certificate, marriage certificate etc) are available in English. Can we keep these blank (Questions 57-58)?

    1. There is no current marriage or current spouse. So where it asks about current marriage put "N/A", and where it asks to list all the spouses starting with the most recent, start with her late husband (since there is no current one), and then all the previous spouses in reverse chronological order, if any. The date the marriage with her late husband ended is when he died.

    2. There is no current spouse, so where it asks for spouse and children, just list children

    3. I think basically, if her name is in a language that uses non-Latin script, then put the native script version there. If her address is in a language that uses non-Latin script, then put the native script version there.
