  • Clarification needed for family based GC

    I am hoping I can get answers here. I am filing GC applications for my parents. They are in the US.

    Looks like I can file the I-130 and I-485 applications at the same time. Can I also send in the Advanced Parole application too?

    1. Can I expect the Advanced Parole to come back quicker than the 485? If so can anyone that went through it recently tell me what to expect?

    2. Can parents leave the country and come back in if the advanced parole is granted even if I-485 is pending?

    3. How long can I expect for the GC process to be done by?

    4. I heard USCIS is trying to speed things up, have we seen any change in processing times for family based GCs?

    Yes, they can file I-765 for EAD and I-131 for Advance Parole, both for free, together with the I-130 and I-485.

    EAD and AP are usually approved before the I-485. That's the whole point of the EAD/AP, for you to use while the I-485 is pending. If I-485 is approved before EAD/AP (which is possible but rare), EAD/AP are no longer needed.

    Yes, they can leave the US after AP is granted, while I-485 is pending. That's the whole point of AP.

      Thanks for the responses. What is the best way to figure out some estimation of how long it will take for the GC process to complete? The USCIS has processing times listed right?

          Sure, why not? They are free, and your parents get SSN with EAD (they get SSN with green card also, but EAD is probably faster). They can also get driver's license/state ID with EAD.
