  • Will a greencard in process, affect a new non immigrant visa application?

    I have a family (sibling) sponsored green card application in process. I have stayed in US for three years through the F1 visa and have a MS degree. Currently I am living outside US. Will my current greencard application which is in process, affect the chances of me getting a non immigrant visa (H1/L1/B1) sponsored by my employer? Will it have any impact?

    H1/L1 are dual intent visas and will not be impacted on a pending immigrant visa petition. B1/B2 will be impacted but again the VO can issue the visa based on discretion. Make sure you mention about the immigrant petition on the visa forms or it could be considered material misrepresentation resulting in serious consequences.

      Thanks for the reply. Yes a transparent representation of all the facts for any further visa applications, there should not be much of a problem.

      The green card was initiated in Nov 2010. What is a realistic time frame I can see for the processing. 2020?

        Current processing time line is 9.5 years.
