  • Will my parents lose their tourist visa if I petition them for a greencard?

I’ve been thinking of petitioning my dad, mom and brother to the US now that I am a citizen.

What will happen to their US tourist visa after filing I-130? Will their tourist visa be nullified?

And say if the I-130 application gets rejected, will their US tourist visa be nullified?

Also, what is the processing time frames these days for I-130 and I-485?

    Thank you.

Their visas remain valid, but there may be increased chance they may be denied entry.

I-485 is the application for Adjustment of Status, the process of getting a green card from within the US. Since they are applying from outside the US, they will do Consular Processing after the I-130 is approved. This process does not involve I-485.

This is my personal opinion and is not to be construed as legal advice.
