  • Divorce after issuance of green card

    Hi guys,

My dad and his family(mom, sis and me) got green card(type F3) through my grandmother(father's mother) who is a citizen. We have had it for two years now. None of us have yet moved to USA.

But my father and mother have separated and will file for divorce soon, here in India.

So my question is what will happen to my mother's green card? Will it get invalidated because they have divorced even though each of us have our individual green cards.

    Thanks.

Sorry to hear about your current situation. Do you all have the physical green cards with you? If your mom has a valid green card, the divorce will not affect her green card.
There is some law that if you guys don't use your green cards, they may be deemed abandoned. I would look into it if I were you.

      Thanks for your reply.

If they divorce here in India, will they be considered the same in USA?

        Anand,

If you leave the US for more than 6 months, the GC may be revoked. You should check into this first, before worrying about your mother. She may be in the same situation too.

Sorry should have mentioned that we have been visiting USA every 6 months till now and have kept it valid. Just wanted to know how getting a divorce here will effect their status as residents of USA.

Just visiting once in a while is not enough for maintaining a green card.
