  • I-864 Affidavit Of Support Form Question - Regarding Household Size

    Hello,

I hope you are all doing well. I’m the petitioner filing for my spouse (the beneficiary) and have reached the NVC stage, where I need to upload financial documents, including Form I-864.

In Part 5 – Sponsor’s Household Size, the form asks:
“If you have sponsored any other persons on Form I-864 or Form I-864EZ who are now lawful permanent residents and you are still obligated to support, enter the number here. (NOTE: Enter ‘0’ if you already counted these persons in Item Number 1.)”

I have a couple of questions related to this:
    1. What does “obligated to support” mean in this context?
I joint-sponsored two applicants in the past 2–3 years. Should I count them here, or not? They are financially in a good position and do not require my assistance anymore.
    2. My income is around $130,000 annually (based in NJ,USA).
One friend I joint sponsored his wife and he listed 3 children; the other friend, only sponsored his wife.
Will my income (according to the NVC) be sufficient to sponsor my spouse on my own, or will I need a joint sponsor?
Please advise whether I need to mention the past sponsorships and how they might impact my current petition. Your guys's assistance is truly appreciated!

    1. If they have gotten their green cards, and none of the conditions for I-864 obligations ending (i.e. they have become US citizens, they have earned 40 Social Security credits, they have lost permanent resident status and left the US, or they died) have occurred, you must count them.
    2. What is your household size?

This is my personal opinion and is not to be construed as legal advice.

      Hi jiggaman97,

      Please see below my response.
      1. obligated to support means that your legal responsibility as a sponsor continues to apply, even if the individuals you sponsored are now financially independent and no longer rely on your assistance.
if you dont want to include them, they should come under below category.
      • the concern person becomes a U.S. citizen,
      • They have worked 40 quarters (10 years) of work in the U.S.,
      • They leave the U.S. permanently,
      • They die
      2. It depend upon your household size. But generally, 130k is well above I feel.

      Thanks
