They will fall into Adjustment of Status ( AOS) category for the filing. You can start whenever you are ready! You can start with the package since they are considered as immediate relatives, and don't have to wait for a visa number! The package is I-130, I-485, I-765 (if the need to work for the I-765) and don't forget the form for vaccination. Check the guidelines here on this website about Adjustment of Status or form I-485 (Green Card application).Good luck.

Thanks for the reply...My situation is as follows:
My parents came to US on Oct 20th, 2010 and went back to India on April 19th,2011. They then returned back to US on May19th,2011.
I read in some places that its better to apply atleast after 60-90 days. And more over in this situation, I felt its more obvious that they entered US with an intention of staying. What would you suggest for this situation?

Consult a lawyer! ask all your questions, and than depending on what the lawyer says, you can file for them yourself! I will do the same thing.
I am not sure about the 90 days for parents, check again. I am sure you have to wait 90 days after marrying an US citizen before you apply.
I don't see any problem to file for them without a lawyer, they are your parents ( immediate relatives) and they did not stay more than their visas, right? Good luck.

If you apply for their visa and they attempt to enter US using their visa, they could be denied entry because of intending immigrant.
Apply when they are here so they can adjust their status.
YOU DO NOT NEED A LAWYER. You can all the information you need within this site. Looks like some lawyers or their assistant frequently visit this site to scare folks away and make them hire lawyers.
          Good Luck!

            Daru,
First in your answer to the question from the member Sairev: You are not sure!!! I quoted you " ...They could be denied entry because of intending immigrant." So how this is going to help??? And before doing any judgment towards my answer to Sairev, you should read my first answer to her which is the same as yours (after mine)!

Let me explain this to you! We are all trying to help here, and people need help! For your own information: I AM NOT A LAWYER, EITHER LAWYER ASSISTANT! I did not refer anyone to a particular lawyer or else... I am a volunteer who helps people with immigration matters for about 7 years now!!! I do it for free and never ask for a fee! I have seen some cases before, thinking I can help myself but it ended up not the way I expected it! I understand people try to save money, but sometimes by doing this they end up paying more because they mess up the first step! Immigration is a complex system, and each person is different! There are some matters that we can help with here on the forum, and some are beyond us!!! From what I witness, I believe that most of time, people need an expert such as accredited lawyers to help them not a regular person such YOU or ME!!!People need advise and I want the best for them here. I am an immigrant, I have been through immigration process! A lawyer helped me the first time, thanks, it was successful! And then from my Employment Authorization renewal to Green Card and Citizenship, I did not pay a dime; I did it myself and everything was fine! I am not here to scare anybody; I want the best for immigrants and others! Do what you can do to help and, please let me help people by putting them on the right path, OK!
