  • I-130 and I-485 concurrent filing

    Hi there,

    My wife is a LPR of USA. I am on F1 visa in USA. Can she file I-130 and I-485 concurrently? What is the benefit of filing both forms at the same time?
    I know, in order to file I-485, priority date must be current.

    hi, I sent all my forms together. It is the best way because everything is processing at the same time

      Hello jbuggy1,

      Even though, we sent all the documents, for AOS, priority date should be current rite? Then only I-485 is processed rite? Could you please provide me some details why it is better to file concurently . I would appreciate your help.

        Only US citizen immediate relatives: spouse, parents and kids under age have visa available to them right away, so they can adjust to permanent residents by filing concurrently! As a LPR spouse, you CANNOT FILE CONCURRENTLY ( I-130 and I-485); you can only file I-130 and wait! The soon you apply, the better! The important thing is this: keep your F1 status, stay in school to make it easy for you to get the benefits when a visa number become available to you! Keep in mind, if your spouse become an US citizen and still your case is pending, you can call USCIS and upgrade your case to the category of US citizen immediate relative. Good luck.

          Jbuggy1, are you getting benefits from an permanent resident relative? Did you file I-130 and I-485 together? if yes, this is wrong and you should see your application sent back soon!All the best.
