  • Is my case complicated? Please help!

    I was in a common law relationship in Canada a long time ago and I obtained Canadian permanent resident card through this relationship . That relationship ended four years ago. I am now married to a US citizen and in the process of applying for a green card. My ex and I didnt file any paper work for the separation since it is not required under the Canadian law. My question is, am I required to disclose my previous relationship on my I 485 form under the section where it asks your previous marriages? If so, how should I disclose it? I don't have a "divorce" date or a file number to prove that relationship ended.

    I am sooo worried right now and any input would be appreciated!

    If you were not legally married to your previous partner then you don't need a divorce. Was it just a live-in relationship and you did not undergo a marriage ceremony ?

      Hi Mtouch, it was just a live-in relationship and we did not undergo a marriage ceremony. But my Canadian permanent residency was obtained through this common-law relationship (I'm now a Canadian citizen), does it make a difference? Thanks.

        No it doesn't matter. US law is different than Canadian law. You are still considered single.
