  • Green card for my mom

    Hi :

    Need your advise.
I plan to apply GC for my mom here pretty soon. What documents do i need to prepare?
ALso, i do not have my mom's marriage certificate. However, i plan to get affidavits supporting their marriage from close relatives. My question is how many affidavits do i need, like from how many close relatives?
Do i have to get a certificate from registrar office that marriage certificate is not available in addition to affidavits or just the affidavits are enough?

Will i be able to use same affidavits for applying GC for my dad also, or do i have to get seperate affidavits from my dad's relatives?

    Please help!

*Are you a US citizen petitioning for your parents' immigrant visa?

*Will they be adjusting status to green card in US?

*OR will you opt for them to get immigrant visas in US embassy outside US?

I will become US citizen in couple of months. I will be doing OAS for my mom here is US as she is with me but for my dad he is in India, so it will have to be outside US for him...

If you download forms I-130 and AOS form I-485 ( to be filed together for your mother),you can also download instructions for these forms . They tell you everything about the documents.
I don't think You will need a marriage affidavit for your mother. Since you will be getting it for your dad, you might as well send it with your mom's I-130 also.
You will need it from two people who were alive at your parents' wedding.
No need to get a non-availability marriage certificate.

Most important is your birth certificate with your parents' names on it. That will prove your relationship to them . Without this there won't be any Conclusive I-130 peition.

Also will be required your parents' birth certificates with I-485 ( mom) and at the time of
your dad's immigrant visa processing in India.

Also important affidavit of support ( I-864) signed by you.

For immigrant visa processing in India, check out US embassy new delhi website , I-130.
