  • I130 Approved

    My friend's mom applied for her permanent residency in 2002. She got a letter from the INS saying that her case is approved.
    Can she come to the United States and stay? If yes, what form does she have to fill out?

    The consulate will be notified and they will send out instructions to your friend's mother to follow. This includes getting a medical, fingerprints, police clearance certificates, etc.

      Will she be able to come to the United States before that or she needs to wait in the country where she lives right now.

        she needs to stay in her country, till several communications takes place between the petioner and the NVC, certains fees needs to be paid, and AOS filed, after all that has been reviewed by the NVC, then they will forward the final paper-work to the embassy of the country of the benificary (friend's mom), they will contact her then. Takes 8-10 months total.

            sorry to chip in;

            A visitor visa means non-immigrant intent which comes in direct
            conflict with an approved immigrant petition.
            If she applies for a visitor visa now, she will be refused without a doubt.
            If she has one already, she may be refused entry at the port of entry.

            Let her wait till she gets her immigrant visa.

              Getting I-130 approval is just the first step in the longggg process. After this the case will be transfered to NVC which will send her the notice to pay Immigrant visa(IV) and processing fee. After paying the fees, the next step would be filling the DS-230 and I-864 forms that are sent by NVC once you pay the IV fees. After that the case moves to home country consulate wherein basically one waits till visa date becomes current for his/her category.

              Visitor visa is an option but highly unlikely because one has to prove non-immigrant intent to qualify for Visitor visa and having and I-130 shows the applicant to have immigrant intent. Having said that, there have been cases where people have been issued visitors visa. The best course of action is to call up senators and congressmen and ask them to change the law which seperates families and works against US family values. People at unitefamiles yahoo group has been doing this for a while. They have been getting good responses from congressmen/senators but they people suffering from seperation to call/approach their congressman asking for help.

                Hi,
                Can you help me where can I find a sample of an approval letter from the INS , I have some friends received those letter from the INS stating that their I-130 was approved, well I'm confused of them because they asking me questions which I don't know the answer, they are thinking why there is request for a US mailing address to communicate with the INS for the processing in that approval paper that they received, I was thinking that's probably if they will hire an attorney for their paper works.I told them to contact their relative in the US but they never herd from them they say.
