  • Labor and I-140 approved for one Role - Change employer and assume a different role

    Hi Immi Gurus,
Kindly help me figure this one out.

I have a Labor and I-140 approved from my current company. I have H-1 B extension done based on I-140 approval for 3 years. This was done for my previous role in my current company - Software Developer

Lately, I moved to assume different responsibilities for the current company and I am not a Product Manager. My current company didn't refile the labor saying the two roles have about 50% tasks in common.

Now, I have an offer from another company for Product Manager position.

I do understand that once the new company transfers my H-1. They have to refile the Labor and I-140. But can I use the old Priority date even for the new role?

    Thanks for your advise,
    Raju

    Yes you can

Yes you can, your role doesn't matter.
Have your approved LC and i-140 copy handy, as your new employer would need that.
