  • Help, need to travel after I-140 approved on non-immigrant visa

    I am in the country on an "I" visa, which is an international journalists visa. It is a non-immigrant visa. I am a Canadian citizen.

    My husband's employer started the greencard process and applied for our I-140 and included me on the application as his spouse. The I-140 was approved in April 2013. But we haven't filed the I-485 yet, and are considering consular processing instead of change of status. No action has been taken after the I-140 approval.

    I just found out that a close family member has passed away, and I need to travel home for the funeral. I don't know what to do, because I've been told that I could be refused entry because I have already expressed my intent to immigrate, and I have a non-immigrant visa. Are they going to ask me about this at the border? Can they see that an I-140 was approved under my name?

    I really need to go home, but am scared I will lose my "I" visa and my ability to work in the US.

    Please let me know what you think I should I do.
