  • L1 Extension

    Hi ,

Initially i was in L1B visa, i completed my first 3 years of L1B term.
Later i applied for extension, i got my L1 Individual extension also approved for next 3 years(March 2016).i applied for GC (EB2) on 2012 ,at the same time , my I-140 also approved. (i,e My L1 Individual & I-140 both are approved on March 2013).

But as per L1 rules - i have to stay Maximum of 5 years.
is it ok to stay based on my L1 extension notice(till 2016)? or is it illegal to stay more than 5 years on L1 Visa?
    since my I-140 also approved.
    Please suggest on this.

    Thanks
    Naga

Even if you were granted extension till 2016, you should not stay beyond the 5th Year. It is illegal to stay on L1B beyond 5th Year.

You cannot stay on L1 based on your approved I140. You have to move to H1. A new H1 cap will start in April 2014, with a start date of Oct 2014.

This is my opinion not legal advice.
