I-140/1099 urgent

Hi

I am filing for I-140, my lawyer seeking W2, but i am in 1099 past 4 years.Is this going to create a problem now and later stages of my GC?
If anyone could help what should i do? Can i switch this year 1099 to W2 through employer before the year end?
