    Hi,
    I am planning on moving from my current company/employer to another (My main reason to switch company is to get into EB-2 category, which I will be fairly eligible when switching company) and need help with few situations:

    My Current Status:
    1. I have PERM and I-140 approved in EB-3 with PD around Oct-2010
    2. I have been in US since may-2004, started on H-1B and currently on I140 based H-1B that does not fall into H-1B cap.
    3. No consultant involved, working directly for the employer who sponsored H-1B and PERM

    if i switch to a consultant or an employer who sponsors the visa and GC.
    1. when should the consultant begin my GC processing and H-1B transfer?
    2. what will be the impact if my current employer withdraws both I140 and H-1B within 90 days of separation with the company?
    3. would there be a risk if USCIC needing Client letter type of thing?
    4. what is the ideal time to submit resignation with current employer? After receiving H-1B file receipt or after receiving H-1B approval assuming H-1B was processed in premium mode.
    5. What care should be taken to ensure, i can port the new I140 (EB-2) to have PD of Oct-2010.
