Job change on approved I140 and Visa about to expire - URGENT PLS HELP
Hi,
I am planning to change my job (To port in from EB3 to EB2) and need help with few situations:
My Current Status:
1. I have PERM and I-140 approved in EB-3 with PD around Jan-2012
2. I have been in US since may-2006, and currently on H1B which is about to expire in Jan 2016
if I change my job, I have following questions
1. I have less than 6 months Visa from my current employer. Can my new Employer file for H1B transfer and extension at the same time?
2. Since my I140 is already approved, will I get 3 year extension when new Employer files transfer plus extension?
3. If my new employer starts my GC process, can I port in my Priority Date, if the old employer revokes my I140?
4. What is the timeline in which, employer can revoke I140?
