Approved I-140, pending H1 extension with USCIS and 6 years completion
I have my I-140 approved with my new company. I transferred H1 with 5 months remaining and had my perm and I-140 approved within that time, but my H1 is still pending with immigration and I am going to complete my 6 years H1. I still have not received any notice for H1 transfer.
My company is saying, I can convert the H1 extension to premium and apply another extension based on I-140. This is fine on a sunny day scenario.
If immigration office does not approve my H1 transfer quoting the 6 years H1 rule, Can i still attach my approved I-140 in a new H1 extension/application and stay in the country?
