Hi,
I am on H1B and will max-out Mar-2018. My employer submitted I-140 in EB-3 just a week before. I now got a chance to move to Canada for a work. same employer but different project. I know when applicant is an International Manager he can apply GC in US under EB1 catergory. But hesitating to take a decision.
Questions:
1) What if i move to canada while my I-140 is in 'applied state' ? will it expire or get rejected if i move out of US?
2) Is there an advantage if i get my I140 approved and then move to Canada ?
3) As my H1B max-out is Mar-2018, is moving to Cananda now is a wise decision ?
4) If I move to Canada now, will i be able to apply for H1B extension (as my max-out will extend as i will secure this 1year ) and then come in to US and apply GC in EB1 category ?
5) Will I really have a EB1 chance when i return back to US while my current application is in EB3
Can someone provide some advice on best path to chose here.
