My priority date is 8 Jul 2002. I just received a labor clearance certificate a day ago. I filed in EB2 category with Master's and 6 months experience. Which means I should be eligible for EB2 category.
According to this, I can file for I-140 and I-485 (probably EAD also) together now but my lawyer is suggesting to file for I-140 only rightnow which will take around 4-5 months and once it gets approved we can file for I-485.
What she is suggesting is there is a possibility that INS will query and tell to put my case in EB3 category because I have showed less experience. I intend to file for I-140 and I-485 together as it might will increase the scope that with 6 months my EAD will get approved and my wife who is on H-4 rightnow can work.
Lawyer has put a ball in my court whether I want to go for just I-140 rightnow or I go to I-140 and I-485 together now.
