I live in Detroit, Michigan.
I am desperately looking for a solution to my lost case.
I have been a student in the U.S since 2001. I worked as PT aid one year after getting my OPT permit which expired 7/01/2006.
On April 11, 2006 I have applied for my work permit, travel documents, I-485 and I-140. I had my travel documents and work permit approved. On September 27, I have received a decision that my I-140 was denied because the posting was not done properly. Here it is: “The notice of filing an application for labor certification does not comply with the regulatory requirements, and as proper notice must have been provided between 30 and 180 prior to the filing of the application, this deficiency cannot now be overcome by the posting of a corrected notice.” “Your petition includes no documentary evidence or employer attestation concerning the publication of the notice in any in-house media.”
Since my i-140 is was denied I am out of status now.
Is there anything what could be done ?
