Labor on H1, I-140 on L1 - possible?

I got Labor cleared while on H1 went to India.
I am back to US now on Blanket L1 visa through the same employer.
My employer is not helping me to file I-140 . Is it really not possible?
(my labor is going to expire in one week's time)
Can I file I-140 on my own?

Labor certification is independence of your visa status H/L/F/B.

You can file I 140 befor your LC expires, 180 days after approval.

But my employer is not co-operating or helping me.
