Out of Status/unauthorised any point to pursue application

Is there any point and hope to pursue our application for EB1 ( exceptional ability) if we were out of status on B2 visa for 24months around 96/97 and also have filed tax returns since 1996 although we have been in and out of the country many times since 97 and although had current 194 at all times the employment was with out permission. We have never been denied entrance but do not know how all of this would affect an application.

It is very subjective whether you would be caught or not.
