I140 Pending - Job Change

Hi,

I have my labor filed 365 before my 6 years on H1. Now my labor is approved and have I-140 filed and pending approval since Non 08. If I get lay off notice after 6 years on H1 and my I-140 is either pending or approved, can i still apply H1 transfer through a different employer or I cannot? Appreciate your replies. Thanks.

You can apply for an extension based on pending I140. But if the company withdraws that, you will be in a soup as per the Neufield memo.
