Hi,
my I-140 was denied on 16th jan' 09. The reason of my denial, as my lawyer says, is in my labor three yrs was shown. but in I-140 5 yrs has been displayed. USCIS shows this as mismatch and denied. my concern --
My H1B visa expires on 10th September, 2009. this will be sixth yr of H1B out of which I have almost 2 yrs of unused H1B time period.
1. will the extension be a problem if I have denied I-140?
2. While extending unused visa, Will USCIS consider labor, denied I-140 etc. ?
Plz suggest ASAP.
