    Hi all,

    Does anyone know if USCIS officer only consider Box 1 of W-2 when reviewing evidence of ability to pay in I-140 petition?

    The proffered wage is $55,000. My total wage is $57,000, which is higher than the proffered wage. But the amount reflected as wages in Box 1 is only $52,000, does not show my total wage. This is because $5000 is deducted pre-tax from the wage to pay for my health insurance premium. This $5000 is reflected in Box 14 (Employers may use this box to report information such as health insurance premium deducted, etc.).

    W-2 should also contains boxes for the taxes and withhelds they will add up to the total. Also when you send your paystubs it shows gross pay.
