  • Impact of getting another I-140

Hello! I have an I-140 from my previous employer in the EB2 category. I stayed more than 180 days with them after approval, thus I am eligible for H1b renewals under the AC21 rule.

Now my current employer is also planning to apply for I-140 in same EB2 category. Are there any benefits or risks in doing that?

If I do not stay with my current employer for 180 days after the approval, can I still get H1b renewals based on the I-140 with my old employer. Or the new I-140 is going to completely replace the old one?

Every I140 stands by itself. There is no such thing as one I140 replacing another. A person can have an infinite number of I140s filed on his behalf. Your current employer has to file an I140 anyways for future sponsorship of your GC.
Just an opinion; Not legal advice.
